Does a docter have the right to not tell someone about a medical condition?

My brother has crones disease and is in the hopital about once a week. He had an abdominal xray and my mom works at the hospital he had it at. She looked at his medical record and seen a 9mm kidney stone. They didn't treat him for this we assume because of his extensive medical bills. I understand they don't have to treat him if it wasn't life or death, but they didn't tell him about it either. In there patients rights it said he has the right to be informed of his medical conditions and proper home and in care treatment. If we bought his medical records ( which we have most of them there are so many its in a box. We are trying to get a disability lawyer.) and hire a lawyer can they be suede for this?
